New Jersey law provides for DUI surcharges, which are separate fines assessed by the Motor Vehicle Commission (MVC). These surcharges are in addition to any court-ordered fines and penalties.
The surcharges related to DUI in New Jersey are:
- $1,000 per year for 3 years for a DUI
- $1,000 per year for 3 year for refusal to take breathalyzer test
If a driver does not pay the surcharges, the New Jersey MVC will indefinitely suspend driving privileges and file an action in the State Superior Court. The result of a court action could be a lien against the driver's property, garnishment of the driver's wages, or similar actions.
